By accessing, visiting, or using https://dronepros.org (the “Website”), you agree to be bound by these Terms and Conditions as well as our Privacy Policy, Advertising Disclosure, Cookie Policy, GDPR Policy, Disclaimer, and DMCA Policy. If you do not accept these terms, you must not use this Website.

All persons under 16 years of age are prohibited from using this Website.

Drone Pros Organization reserves the right to deny access to any person for any reason.

These Terms may change at any time, and it is your responsibility to stay informed of updates.

1. Parties to This Agreement

These Terms and Conditions apply to all visitors, members, subscribers, affiliates, partners, vendors, and contractors of Drone Pros Organization (DPO).

2. Use of Website Information and Digital Assets

•No individual or entity may copy, distribute, resell, broadcast, or commercially exploit any content, digital assets, or proprietary materials from this Website without express written permission from Drone Pros Organization.

•Unauthorized use may result in legal action, including, but not limited to:

•Injunctive relief

•Monetary damages

•A minimum liquidated damages fee of $100,000 per violation, in addition to other damages, lost revenue, and legal enforcement costs.

3. Membership, Payment Plans, and Refund Policy

By purchasing a Drone Pros Organization membership, you agree to the following terms:

3.1 Non-Refundable Membership Fees

All membership fees are non-refundable and non-transferable.

•Upon registration, members receive immediate access to proprietary digital assets, which cannot be returned or refunded.

3.2 Payment Plans & Forfeiture of Payments

• If a member chooses a payment plan, they must complete all scheduled payments in full.

• If a payment is missed, declined, or canceled, the membership will be immediately terminated, and all prior payments will be forfeited.

Failure to complete a payment plan does not release the member from their contractual obligation to pay the full agreed amount.

3.3 Chargebacks & Unauthorized Payment Reversals

•If a member disputes a payment (chargeback) through their financial institution:

Membership will be immediately terminated without reinstatement.

•The member will be charged a $100 administrative fee per chargeback, plus any transaction fees incurred by Drone Pros Organization.

• The member will be fully liable for all legal fees, penalties, and collection costs associated with the chargeback dispute.

3.4 Liability for Legal & Transaction Fees

•If Drone Pros Organization incurs costs due to a chargeback, dispute, or contract violation, the member agrees to be fully responsible for:

•Attorney fees

•Court costs

•Collection fees

•Regulatory fines

3.5 Membership Cancellation Policy

• By default, annual memberships automatically renew unless a cancellation request is submitted.

• To prevent future billing, members must submit a cancellation request at least three (3) business days before the renewal date.

• Cancellation does not entitle a member to a refund. The membership remains active until the end of the current billing cycle, but no further charges will be made.

• To cancel, members must submit a request using one of the following methods:

• For faster processing, members should include their registered email and, if possible, the last four digits of the credit card used for payment.

4. Member Profiles, Data Use, and Third-Party Interactions

4.1 Required Member Profile Information

Upon registration, members must provide:

•Full name, contact details, and zip code

•FAA certification number and waivers (if applicable)

•Years of experience and services offered

•Website and social media links

4.2 Data Sharing for Work Matching and Networking

•Members understand and agree that their profile information (excluding passwords and payment data) may be shared with:

Potential work opportunities submitted to Drone Pros Organization.

Other members for the purpose of networking or partnering on drone contracts.

4.3 Disclaimer of Responsibility for Data Use and Misuse

Drone Pros Organization is not responsible for:

• Any interactions, agreements, or disputes between members.

• The accuracy of member-submitted data.

• Any unauthorized use or misuse of member data by third parties.

4.4 Liability for Legal and Financial Costs Due to Misuse

• If a member misuses data (e.g., spamming, fraud, unauthorized data scraping, or deceptive practices):

Their membership will be revoked without refund.

•They will be held legally responsible for all damages, penalties, and associated costs.

Drone Pros Organization is not liable for any disputes, claims, or legal actions arising from such misuse.

5. Drone Pros Organization Is Not an Employer, Broker, or Agent

Drone Pros Organization does not employ, manage, or contract drone pilots.

•Members are independent businesses and are fully responsible for their own:

•Work and service agreements

•Payments and collections

•Tax reporting and legal compliance

Drone Pros Organization is not liable for employment disputes, contract breaches, or business dealings between members and third parties.

6. Non-Disparagement Clause

• Members agree not to publish, post, or communicate any false, misleading, disparaging, or defamatory statements—whether written, verbal, online, or otherwise—about Drone Pros Organization, its services, its representatives, or other members.

• This includes, but is not limited to, statements made on social media, public forums, review websites, blogs, email communications, or direct messages to third parties.

• Any violation of this clause may result in legal action, monetary damages, and termination of membership.

• Members expressly waive their right to a jury trial and agree that arbitration shall be the sole and exclusive means of resolving disputes related to Drone Pros Organization’s services, memberships, payments, and digital assets.

• Arbitration applies to all claims, including contract disputes, fraud claims, and statutory claims.

• No party may circumvent this arbitration requirement by attempting to bring related claims in any other jurisdiction.

7. Governing Law, Arbitration, and Legal Costs Responsibility

•These Terms and Conditions shall be governed by the laws of the State of Idaho, United States.

• Any disputes shall be resolved exclusively through binding arbitration in Ada County, Idaho, under AAA (American Arbitration Association) rules.

If Drone Pros Organization prevails in any legal dispute, the member agrees to pay all legal fees, arbitration costs, and damages.

•Members waive any right to file class-action lawsuits against Drone Pros Organization.

• Arbitration shall apply to all disputes, claims, or controversies arising from or related to these Terms, membership, payments, services, or any alleged fraudulent, misleading, or unlawful conduct.

Neither party may seek relief through state or federal court except for enforcement of the arbitration award.

The initiating party in arbitration shall be responsible for the filing costs, unless the arbitrator rules otherwise.

8. Indemnification

•Members agree to indemnify, defend, and hold harmless Drone Pros Organization from all legal claims, damages, and liabilities arising from:

•Use of the platform

•Violation of these Terms

•Disputes with third parties

• Members further agree to indemnify, defend, and hold harmless Drone Pros Organization against any claims, liabilities, losses, or damages resulting from:

•Unauthorized use, copying, or distribution of digital assets.

Intellectual property infringement related to content posted or shared by members.

Unauthorized access, data breaches, hacking, or security vulnerabilities caused by the member’s use of the platform.

•Misuse of Drone Pros Organization’s networking tools or data-sharing features.

• Members further agree to indemnify, defend, and hold harmless Drone Pros Organization against any claims, liabilities, losses, or damages resulting from:

Regulatory violations (including FAA violations) or non-compliance with federal, state, or local laws.

 

•Claims from third parties (such as customers or business partners) related to a member’s services, representations, or actions.

9. No Warranty or Guarantee of Service Availability

• Drone Pros Organization does not guarantee continuous, uninterrupted access to its website, services, or digital resources.

• Service availability may be affected by technical failures, server downtime, security incidents, system updates, or external factors beyond our control.

• Drone Pros Organization is not liable for any loss of business, revenue, or opportunities resulting from service disruptions, modifications, or discontinuation of any features or services.

• Drone Pros Organization reserves the right to modify, suspend, or discontinue any services, features, or digital assets at its sole discretion, without prior notice.

Drone Pros Organization is not responsible for any technical malfunctions, data loss, or service failures, whether caused by server issues, software updates, security incidents, or third-party service providers.

10. No Guarantee of Income or Work Opportunities

• Drone Pros Organization does not guarantee that membership will result in business opportunities, paid work, financial gain, or career success.

• Members acknowledge that their ability to secure work, generate revenue, or benefit from the platform depends entirely on their own efforts, business strategy, and industry demand.

• Drone Pros Organization shall not be liable for any lost income, lost revenue, missed opportunities, or lack of success resulting from a member’s participation on the platform.

Drone Pros Organization makes no representations or warranties regarding a member’s ability to obtain work, generate revenue, or secure financial success through the platform.

• Any testimonials, earnings statements, or success stories shared by Drone Pros Organization are examples only and do not guarantee results.

• Members agree that they are solely responsible for their own success, client relationships, and financial performance.
